Internal Rules of the House Owners Association.

CONSTITUTION FOR THE OWNERS AND RESIDENTS OF
URBANIZATION PLAYA GOLF 2
PARCELA R2

1. It is the duty of all owners and residents to adhere to and enforce thisconstitution in order that all of us can live in a quiet, peaceful and safe urbanisation environment without conflict or pain.

2. As a residential urbanisation it must be remembered that some residents work for a living. In recognition of this, NOISE whether it be music, loud shouting, car, or any other noise must be kept to a minimum between the hours of 12 midnight and 8.00 a.m. and consideration should be shown to others at all times.

3. Dog owners are responsible for cleaning up after their animals. Failure to do so will incur a penalty fine of 50 euros on each occasion. These fines will be in the form of a supplementary rate which is recoverable by law.

4. It is the responsibility of all owners to dispose of their rubbish only in the authorised bins. Any FLYTIPPING (illegal dumping of both household and garden waste) will incur the same penalty as in item 3.

5. Cars and all other vehicles must only be parked in authorised parking areas(either a marked parking space or off road on your own property). This is to keep roads clear for emergency vehicles and to avoid blocked roads. Offenders' vehicles may be removed at the owners' cost and risk

6. If renting out your property you must provide a copy of this constitution to your renter so that they are in no doubt as to what is; and what is not; acceptable behaviour on this urbanisation. A copy should be left in a prominent position inside the property.

7. Rules for the pool will be presented separately and in the interest of safety and hygiene must be adhered to. Anyone failing to do so may be reported to the local police who can remove them.

8. Alcohol and glass are strictly banned from the pool area. This is for safety and to avoid conflict.

9. The Management of the urbanisation areworking to provide a safe, quiet and peaceful environment for us all to live in. When asked by one of these (or any owner) to stop doing something or when asked for help by them, it is your duty to do so. They do not deserve to be abused or assaulted. Anyone doing so will be prosecuted by the urbanisation.

10. Graffiti and vandalism will not be accepted. Prosecution is guaranteed.

11. No signs, placards, or advertising boards other than "For Sale" or "For Rent" boards will be erected anywhere on the urbanization and all such signs must be approved by the Management Committee. No property shall be used as a primary place of business and no business shall be carried out in the streets or open spaces of the urbanisation. Contractors working on owner’s property will be allowed to have signs or posters displayed on the property being worked on measuring no more than A4 in size. These can be left for as long as the property owner allows. Larger signs measuring no more than A3 will be allowed for up to 1 month.

12. a. No property owner shall change the colour, shape or general appearance of their property in any way whatsoever without the prior agreement of the Management Committee and in any case extensions, garages and sheds over 1.60 metre high will not be allowed.

b. Awnings and blinds must be in keeping with the general colour scheme of the urbanization (i.e., gold, yellow, terracotta, cream and white)

c. No fixed washing lines will be allowed on the ground floor of properties. Washing must never be hung over balustrades or fences, and this includes bedroom balconies. Rotary clothes driers will be permitted on properties where there is no available roof space for drying washing.

d. No changes may be implemented that may be in contravention of local and national law and in all cases the correct planning permissions must be obtained prior to any works being started. Any breach of this rule will result in the property being returned to its original condition (at the full cost of the owner) by the urbanisation. Owners may appeal against any decision made on this issue at a general meeting but must obtain a unanimous vote to overturn the ruling of the Management Committee. Failure to obtain unanimity will result in the STATUS QUO being maintained.

13. Anti-social behaviour, no matter what kind, will not be tolerated. Our common aim is to improve our environment and the value of our properties. Any action by owners which denigrates this aim will be deemed against the common good and will be dealt with accordingly.

14. Non-payment of community charge: -

  1. A surcharge of 20% will be added to fees that are not paid within the established periods. (October)
  2. A charge of 300€ will be made for each registered letter that will be sent to the debtor with regard to recover payments not made by December
  3. A charge of 700 € will be made for each burofax that will sent to the debtor to start legal proceedings with regard to recovering payments not made by January

In all cases names and addresses of all debtors will be posted on all community notice boards and use of the pool will be denied until debts are settled.

(PLEASE NOTE that the community does have the right to take legal action to sell your property if you do not pay your community charge)

15. No amendment shall be made to this constitution without a unanimous vote and in any event no amendment shall be made which is contrary to all relevant Spanish laws or which may render the constitution illegal in any way whatsoever. Should laws change or for any other reason this constitution is deemed to be outside the law, the Management Committee will have the duty to re-frame and implement the amendments necessary to bring the constitution back to legality.

16. The maximum number of pets to be allowed on any property is restricted to 2, but the property owners that have more pets on the date of the AGM (12-09-2006) are allowed to keep them.
